Below are the legal mandates for arts education as stated in the California Education Code.

Arts Education

Education Code Section 8811 (1992, Mello): Defines the “arts” to include the four disciplines of dance, drama and theatre, music, and visual arts as set forth in the state's adopted curriculum framework for visual and performing arts.

Art and Craft Materials Hazard List

Education Code Sections 32060-32066 (1987): Prohibits schools from ordering or purchasing any product that contains toxic or carcinogenic substances for use in grades K-6. The law also restricts the purchase of such products in grades 7-12, allowing the use of these materials only if the product bears a label informing the user of the presence of hazardous ingredients, the potential health effects, and instructions for the safe use. The California Office of Environmental Health Hazard Assessment (OEHHA) develops and periodically updates the lists of art and craft materials that cannot be purchased or used in Kindergarten and in grades 1-6, and grades 7-12. The Department of Education distributes the lists to all school districts and the governing authorities of all private schools in California, and makes the lists available to pre-schools, childcare centers, and other businesses and organizations that involve the use of art or craft materials with children. The list may be reached at http://www.oehha.org/education/art/artguide.html for the OEHHA Web site link.
