Below are the legal mandates for arts education as stated in the California Education Code.
Arts Education
Education
Code Section 8811 (1992, Mello): Defines the “arts” to include the four
disciplines of dance, drama and theatre, music, and visual arts as set
forth in the state's adopted curriculum framework for visual and
performing arts. Arts Work Grant Program
Education
Code Sections 8820-8830 (AB 1512, enacted in January 2004): Establishes
the Arts Work Visual and Performing Arts Education Program for the
purposes of awarding grants to local educational agencies to develop
the capacity to implement high-quality, instructional programs based on
the state visual and performing arts content standards.
Art and Craft Materials Hazard List
Education
Code Sections 32060-32066 (1987): Prohibits schools from ordering or
purchasing any product that contains toxic or carcinogenic substances
for use in grades K-6. The law also restricts the purchase of such
products in grades 7-12, allowing the use of these materials only if
the product bears a label informing the user of the presence of
hazardous ingredients, the potential health effects, and instructions
for the safe use. The California Office of Environmental Health Hazard
Assessment (OEHHA) develops and periodically updates the lists of art
and craft materials that cannot be purchased or used in Kindergarten
and in grades 1-6, and grades 7-12. The Department of Education
distributes the lists to all school districts and the governing
authorities of all private schools in California, and makes the lists
available to pre-schools, childcare centers, and other businesses and
organizations that involve the use of art or craft materials with

Elementary Arts Education Requirement
Education Code
Section 51210 (Amended by Chapter 530, 1995): Course of Study, Grades 1
to 6: Visual and performing arts, including instruction in the subjects
of dance, music, theatre, and visual arts, aimed at the development of
aesthetic appreciation and the skills of creative expression. Secondary Arts Education Requirement
Education
Code Section 51220 (Amended by Chapter 530, 1995): Areas of Study,
Grades 7 to 12: Visual and performing arts, including dance, music,
theatre, and visual arts, with emphasis upon development of aesthetic
appreciation and the skills of creative expression.
High School Graduation Requirement

51225.3 (Senate Bill 813, enacted in 1983): Includes among the academic
subjects required for graduation from high school a year of a visual or
performing arts (dance, music, theatre, or visual art) or a year of
foreign language. Visual and Performing Arts Content Standards
Education
Code Section 60605.1 (Senate Bill 1390, chaptered September 2000):
Requires the State Board of Education to adopt content standards,
pursuant to recommendations developed by the Superintendent of Public
Instruction, in the visual and performing arts. (Standards adopted by
State Board of Education January 10, 2001). Arts Textbooks and Instructional Materials
Education
Code Section 60242.(1) (Senate Bill 469, Assembly Bill 1173, chaptered
September 2003): Permits purchase of visual and performing arts
textbooks and materials using state instructional materials funds after
school district certifies textbooks in reading, math, science and
history/social science have been provided to each pupil.
